Compulsory Third Party (CTP) insurance fraud makes things more expensive for everyone. If you make a fraudulent CTP injury claim, you risk significant fines and lengthy jail sentences.

 

What is CTP insurance fraud?

Fraudulent claims increase the overall cost of registering your vehicle, as CTP insurance is included in your vehicle’s registration fee.

Examples of fraud include: 
  • claiming for an injury when you weren’t involved or injured in a crash
  • lying about how an injury happened, loss of income or how it affects your life
  • giving false or misleading information to support your claim
  • deliberately not disclosing your complete pre-accident claims, medical or criminal history
  • providing false documents.

Penalties

CTP insurance fraud is against the law. If you make a fraudulent CTP claim in Queensland, you can be criminally prosecuted.

Penalties include:
  • fines of up to $69,080 as at 1 July 2026
  • up to 18 months in jail
  • recording a criminal conviction against you which can make it harder to get or keep a job.
  • repaying large sums of money.

Reporting

If you know someone who is not being truthful in their CTP claim, report it. Reports can be made anonymously. For privacy reasons, MAIC cannot provide updates on investigations.

Investigation

If a report relates to a Queensland CTP insurance claim, MAIC will pass it on to the insurer handling the claim, where a claim is in progress.

The insurer will review the details and decide whether to investigate further or take action. For privacy reasons, we cannot confirm if the person reported has made a claim or provide updates on the insurer’s investigation.

If the insurer finds enough evidence of fraud, they may refer the case back to MAIC for a potential prosecution under the Motor Accident Insurance Act 1994 (Qld). MAIC will decide whether there is sufficient evidence to undertake a prosecution against the person for an offence.
